This Privacy Policy applies to all personal information collected by NeoGenix Biosciences Pty Ltd and NeoGenix Fertility Pty Ltd (together, NeoGenix, we, us, or our) through the website located at neogenixbiosciences.com (Website). It explains what we collect, how we use it, and your rights under the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs).
This policy relates to information collected through our Website. Data handled by our SpermSearch.AI clinical software within IVF laboratories is governed separately, under our agreements with those clinics and the documentation supplied with the software.
1.What information we collect
The personal information we collect depends on how you use the Website. It may include your name, email address, company or organisation name, and country. When you contact us through the form on our Website, we collect the details you enter so that we can respond to your enquiry.
Like most websites, our hosting platform also automatically collects non-identifying technical information, such as your browser type, language preference, referring site, and the date and time of each request. We use this information to understand how our Website is used and to improve it. In most cases this information does not identify you personally.
2.Types of information
The Privacy Act defines different types of information, including Personal Information and Sensitive Information.
Personal Information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether or not the information is true, and whether or not it is recorded in a material form. If information does not disclose your identity or allow it to be reasonably worked out, in most cases it is not Personal Information and is not subject to this policy.
Sensitive Information includes information or an opinion about things such as your racial or ethnic origin, political opinions, religious or philosophical beliefs, membership of a professional or trade body, criminal record, or health information. We generally do not collect Sensitive Information. Where we do, we will use it only for the primary purpose for which it was collected, for a directly related secondary purpose, or with your consent or where required or authorised by law.
3.Our contact form
When you submit the contact form on our Website, the details you provide (such as your name, email address, organisation, role, and message) are sent to us by email through a third-party form provider so that we can read and respond to your enquiry. We use this information to reply to you and, where relevant, to keep in touch about our products and services. You can ask us at any time to stop contacting you.
4.Cookies and analytics
A cookie is a small text file that a website stores on your device and that your browser sends back to the website on later visits. Our Website is built on Squarespace, which uses cookies that are necessary for the Website to function, to remember your preferences, and to help us understand how the Website is used.
We may also use analytics tools, such as the analytics built into our website platform, to collect non-identifying information about how visitors find and use our Website, so that we can improve it. This information is used in aggregate and does not normally identify you personally.
You can set your browser to refuse some or all cookies, or to alert you when a cookie is being set. If you disable cookies, some parts of the Website may not function properly.

We only use Personal Information for this purpose where we collected it directly from you, and every marketing message includes a simple way to opt out, such as an unsubscribe link. We do not use Sensitive Information for direct marketing.
7.Who we share your data with
We use a small number of trusted third-party providers to operate our Website and respond to your enquiries. These currently include:
- Squarespace, which hosts our Website and provides website analytics.
- Our contact-form provider, which processes the details you submit through our contact form and delivers them to us by email.
We only disclose Personal Information to providers who need it in order to provide their service to us, and only so that they can perform that service. Your Personal Information may also be seen from time to time by maintenance and support personnel acting in the normal course of their duties. We do not sell or rent your Personal Information to anyone. Some of these providers may store or process information overseas (see section 10).
8.Security, access, correction, and deletion
We store your Personal Information in a way that reasonably protects it from unauthorised access, misuse, modification, or disclosure. When we no longer need your Personal Information for the purpose for which it was collected, we take reasonable steps to destroy, anonymise, or de-identify it. Most Personal Information held in our records is kept for up to 7 years to meet our record-keeping obligations.
Under the Australian Privacy Principles you may obtain access to the Personal Information we hold about you in certain circumstances (APP 12) and ask us to correct inaccurate Personal Information (APP 13), subject to certain exceptions. You can also ask us for a copy of the Personal Information we hold about you, or ask us to delete it, by emailing us using the details below. We will respond within a reasonable time and in accordance with our obligations.
9.Complaints
If you have a complaint about how we handle the privacy of your Personal Information, please contact us using the details below. All complaints are considered by our Privacy Officer, and we may seek further information from you to clarify your concerns. If we agree that your complaint is well founded, we will work with you to take appropriate steps to fix the problem. If you remain dissatisfied with the outcome, you may refer the matter to the Office of the Australian Information Commissioner (OAIC).
10.Overseas transfer
Some of our service providers, such as our website hosting and form-handling providers, may store or process your Personal Information overseas, including in the United States. Where this happens, we take reasonable steps to ensure your Personal Information is handled in a way consistent with this policy and the Australian Privacy Principles.
11.Your rights under the GDPR and UK GDPR
